We do not warrant or make any representations concerning the accuracy, legality, decency, or any other aspect of the content found on such sites.
We strongly encourage You to read the terms and conditions and privacy policies of any third-party websites You visit. Your use of third-party websites is entirely at Your own risk.

We reserve the right to terminate or suspend Your access to the Service immediately, without prior notice or liability, for any reason, including — but not limited to — a breach of these Terms.
Upon termination, Your right to use the Service will cease immediately.
All provisions of these Terms that by their nature should survive termination shall survive, including — without limitation — intellectual property provisions, disclaimers of warranties, and limitations of liability.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company, its Affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, punitive, consequential, or exemplary damages — including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses — arising out of or related to Your use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the Company's total cumulative liability to You for any and all claims arising out of or related to the Service shall not exceed one hundred United States dollars (USD $100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the Company's liability shall be limited to the maximum extent permitted by law.
8. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided to You on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, the Company expressly disclaims all warranties, including — but not limited to — implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company does not warrant that:
- The Service will meet Your specific requirements or expectations;
- The Service will be uninterrupted, timely, secure, or error-free;
- Any results obtained from the use of the Service will be accurate or reliable;
- Any errors in the Service will be corrected.
Without limiting the foregoing, the Company makes no warranty or representation regarding any information, content, or materials obtained through the Service, including any real estate-related information, which is provided for general informational purposes only and does not constitute professional real estate, legal, or financial advice.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer. In such jurisdictions, some or all of the exclusions and limitations in this section may not apply to You, and Your rights may be governed by the laws of that jurisdiction.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah, United States of America, excluding any conflict-of-law rules or provisions that would require or permit the application of the laws of any other jurisdiction.
Your use of the Service may also be subject to other local, state, national, or international laws and regulations.
10. Disputes Resolution
If You have any concern, dispute, or claim arising out of or relating to the Service or these Terms, You agree to first attempt to resolve the matter informally by contacting the Company at hello@jacobmorleyrealestate.com. We will make a good-faith effort to address Your concern promptly.
If the matter cannot be resolved informally within a reasonable time, either party may pursue their rights and remedies through the courts of competent jurisdiction in the State of Utah, as provided under the governing law set out in these Terms.
Nothing in this section prevents either party from seeking emergency or preliminary injunctive relief from a court of competent jurisdiction where necessary to protect their rights pending resolution of a dispute.
11. For European Union (EU) Users
If You are a consumer located in a European Union member state, You may benefit from mandatory provisions of consumer protection law in Your country of residence. Nothing in these Terms and Conditions is intended to limit or waive any rights You have under applicable EU or member-state consumer protection legislation. Such mandatory rights apply in addition to these Terms, and where these Terms conflict with those rights, the applicable mandatory law shall prevail.
12. United States Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country; and
- You are not listed on any United States government list of prohibited or restricted parties, including but not limited to the Treasury Department's list of Specially Designated Nationals.
13. Severability and Waiver
Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or — if modification is not possible — it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Waiver
A failure by the Company to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision. Any waiver of a right or provision must be made in writing and signed by an authorized representative of the Company to be effective. A waiver in one instance shall not be deemed a waiver of the same or any other right or provision on any future occasion.
14. Translation Interpretation
These Terms and Conditions may be translated into other languages for Your convenience. In the event of any discrepancy, inconsistency, or conflict between the English version and any translated version, the English-language version shall prevail and control in all respects.
